Hi SMUSSA, I am in the same situation as yourself! Jins letting agency has not forwarded on the rent monies owed to myself. I have called the agency numerous times to be advised she is not there. I have also called her mobile number and she has promised me my rent when she returns to the office , I asked her if she can pay this by internet banking at home and she replied she has NO internet at home! even though she was running her business from home in 2008!! From this day the mobile has now been switched off! Also I have been advised that the tenents deposit has not been placed into a Deposit Protection Scheme!

No, I personally have not reported this incedent. Would it be possibe for all people who have not had there rents paid go to the police to show the scale of this.. The office is manned, but the person there cannot help in rent payments, her mobile number has been switched off for approx 2 weeks

Our tenants deposit is not in the deposit protection scheme. She pays rent 3 monthly. starting from January this year. Jin paid that. From April we have asked the tenant to pay the rent directly to us. Jin still has the 6 weeks deposit. We have reported this to the police with information given above.

Further to my comments yesterday, I have today been interviewed by the Police. This has been registered as a Criminal Offence which will involve the Police, not Civil. Please note the new Metropolitan Police Log: CHS10797 of the 19/4/11. The wheels have now started turning and as I stated before it is imperative that all Landlords associated with Jin's Lettings should contact the Metropolitan Police stating the new reference number. It is no good giving Jin;s Lettings any further time. Whether Jin Hardy is ill or not, business is business and all Landlords should tell their tenants to stop any Standing Orders to Jin's Lettings and they should find another letting agent. I myself have transferred all my tenants to Huggins & Co in New Malden, tel. no: 0208 942 7733 and the contact there is Paul Farren. He has been very helpful to me and in a matter of 2 weeks he has had new contracts drawn up for my tenants and I am now receiving rent. Best of luck to you all, but you have to get on with it now. Agreed. However recovering the money (fat chance of that but worth a go!) is a civil matter and not a Police matter.

Do as I have done as a Landlord, report to the Police using details above (thanks Rod BTW, very useful) AND take civil action AND report to Trading Standards. All the detrails are above.This is the only way you might get your money back, however I suspect that there is a long line of creditors so you probably need to consider budgeting to write the loss off.
BTW, Keys went round to my tenants the same day I contacted them with a Korean interpreter and had a new contract drawn up withing 48 hours and also went and retrieved all my files from Jins, retrieved the rent as it was due plus put me in contact with a solicitor so I could start proceedings. They also have a list of the lucky 20.
As with any letting agent (and I am now taking my own advice in hindsight) make sure that they are a member of a professional body and that the deposit is protected.

It is worth checking on your house (or motor) insurance to see if you are covered for legal expenses. I have been in touch with my insurance company and I am covered. So as you rightly say, to try and get monies back you will have to go through the Civil Courts - but at present I am only interested in nailing Jin's Lettings for what she has done to me - and us all. The reason why I am going to the Police first is that if Jin or Jin's Lettings are prosecuted for fraud - and this is proved - then the making of a Civil case would be much easier as she would have already been convicted for fraudulent actions. It may be the case that Jin is ill - to whatever degree we don't know - but this is no excuse for her current actions. Any good business should have people in place who can deal with the day to day running, although the Principal is absent. Just for the record - I am out of pocket over £6000.00. Not good.

I was actually surprised as to how good these people are!
Im at the office for any one who has any questions, 0208 336 1566 9 till six monday to sat. To alleviate your fears Jins has two accounts with the deposits in and I am happy to show you all a large positive credit in each just visit the offices. Im suprised by the comments and panic here JIn is a very very sick lady she is either at home or having treatment in hospital depending on the time of day . Those who have bothered to visit her have confirmed to me that she has given them a cheque for the rent this month. 11 payments were made by tenants and 7 landlords have been paid for april which means she owes 4 for April out of 150 property clients were waiting for the rest of payments to arrive. Those that have just come to see me for the first time with more than one month owed please visit JIn im sure she will be happy to help you and to see you. She has successfully served in new malden for over 21 years so reconsider all your comments please for this lady All the best Simon

I have asked in writing 7 days ago for my deposit to be transferred to my new Estate agent. This has not happened.
Too many empty promises. Too many excuses. Jin could have easily given a Power of Attorney or even employed someone competent to run her affairs.
Folks, when you are reporting this to the Met, don't forget to add Simon as being involved. His delaying tactics are exemplary.
Does Jin know that you are advising everyone to tell their tenants to stop paying Jin, maybe this is just to help Jin go under and then u can blame everyone for it!!!

i too am owed money by jins about £2,600. Have spoken to Simon who assures me and will send me proof of where the deposits are held.
Also that creditors have to go to jins house to get paid.
This is the most weird situation i have ever encountered and will be going to Police if i am not paid soon.

Simon called after going to Blagdon Road and stated that Jin has not been seen there for a week. He now believes that it is very likely that she has disappeared with the money.
Simon states that the deposit is in a scheme but has yet to provide any form of proof despite numerous promises.

Guys- I know Jin personally, and in fact helped out at Jins Lettings for a 6 month period until February 2010. I can totally understand the frustration of the landlords that are owed money and it's difficult to try and defend the indefensible and I'm not going to try; however SMUSSA, it's completely unethical to publish Jin's private address on the internet. She is indeed very unwell. To mock 'does anyone know whether she is alive or dead?' is completely unsavoury, irrespective of who she owes money to.
As for Simon, put yourself in his shoes, the poor guy is just trying to to earn a living as we all do. He has nothing to do with the finances in the business whatsoever and goes to work everyday attempting to' push water uphill' single
handedly.
If landlords are owed money and they believe that Jin has embezzled their money, then this should be directed through the correct channels and not vigilante comments on this site.

I too am out three months rent from January to March. Approx 5,000 pounds. After getting the same stories from Simon as the rest of you, I transferred my rental to Keys Residential who were incredibly helpful. They visited my tenant and put him at ease, and thank goodness his deposit was transferred with no problems. It had been held by DPS. I will register my complaint with the police too.

thanks jin and simon for your hard work, really appreciate to have an agency and have given them deposit and administration fees to avoid dealing with the landlord, who now wants me out because i ve paid jins. sorry but the contract says to pay the agency and also i had no letter from the landlord asking me to pay directly. thank you for your posts guys...

THANK GOD!!!! I came across this, I thought I was the only one who was having this problem with Jins. I went to see Jins, spoke to Simon who advised me to obtain rent directly from tenant, he even gave me a letter to give to my tenant authorising him to pay direct to me. NOW my tenant is refusing to pay me rent as he has been informed he will not get his deposit back. What can I do?

Simon is not the most discreet of characters and I find it difficult to believe that Jin would have left him there to carry the can if she had dishonest intent. Simon mentioned to me that Jin had been attempting to sell the business but her debts made the business almost worthless. It occurs to me that whoever was trying to buy it probably has far more information about this. Simon (in his indiscreet way) did actually tell me the details of who it was but I won't share them here as that would be unfair to that party were it untrue.

LandladyKT3...the tenant will ALWAYS get their money back as if Jin has run off with it, you as the landlord would have to replace it. If you need to validate this (and I have) speak to another letting agents such as Andrew at Keys (details above).

You have less chance of exposing what you are doing with/to Jin's and any danger of slandering people or organizations is vastly reduced!
However if you insist on posting on a publicly available site.... Please report your problems with Jins and Simon to// Police // Consumer Direct // Trading Standards // Your local MP // the BBC // and seek legal advice from a solicitor. Also its worth looking at MoneyClaim online.
And, last but not least, I had the privilege of being probably one of the rare people seeing the actual paper version of the written draft business purchase agreement between Dean (Keys Residential) and Jin "flying about" on Jin's desk in her reception area! Figures to be disclosed soon! As I was told, Keys would honour all debts if the deal was to pull thru. I would be very cautious of this deal though and in the present circumstances this would not be a wise business decison at all giving the bad reputation and all. But this is, of course, up to Keys....

Landlords are responsible for making sure the deposit is kept safe with one of the schemes even if they use a letting agent to look after the deposit.
The scheme provider will expect you as landlord to pay it back any money it has to pay to the tenant if it is unable to get the money from the managing agent. You should therefore consider what arrangements your agent has made to keep tenants’ money separate and available even if it goes out of business.

Helga I know all about the deal you refer to. Happy to discuss on a closed board, but not in public. The due diligence of the potential buyer flagged up many irregularities, many of which are detailed above by those who are owed tens of thousands in rent and deposits by Jin's with little recourse except via the courts.
Simon as well as Jin can join FB anytime under any name - sorry guys, will not join FB. So I will keep on with my updates on this matter on our community site.

Helga, the FB board is a closed board, you need to pass the scrutiny of the admins and is far more secure than this board which is read by a small fraction of the NM community.
I think you need to look up the meaning of slander and realize how much it could cost you to settle out of court...... Whether you can prove it or not is nor the point...the COST of doing so is the point and is considerable.
SMUSSA - Slough is good, not sure anywhere near NM is a good idea. Only those who have been vetted via your FB site allowed.
I had no business dealings with Jin but still know in detail her business connections and late dealings with Keys. Not sure if I could be of great help but will surely try to help and share what I know.

The only way to protect yourself in the future is to choose your letting agent wisely and ensure they are members of ARLA and have client money protection insurance. Unfortunately a number of amateur landlords go into it with their eyes shut.
If Jin has disappeared with any rent/deposits then I believe that any money you spend trying to recover it will be money wasted. I would be astonished if Jin operated as a sole trader and so any contract that landlords have will be with the company trading as Jins rather than her personally. When APM Compass closed down, were the police interested? Not a bit..... Do some research and see if you can find out how many people have been prosecuted for actions such as this and I bet you won't find many.
I have been a landlord in New Maldenfor over 30 years and seen too many companies go to the wall. When I started I was naive and there was practically no choice of agents but that has changed dramatically. Landlords, do your homework and use a decent agent that you feel you can trust but most of all make sure they are ARLA regulated.

Landlords, keep chasing Jin. I have done and have recovered all outstanding rent, just the deposit to go. Use all the methods detailed above, Police, TS, Consumer Direct etc to put pressure on Jin and Jin's Lettings. At least start a claim with MoneyClaim online (It's cheap!) to recover rent owed. Lets not allow these folks to escape unharmed with our money! Of course you could just roll over and do feck all.........................
